Privacy policy
This policy explains how Nivaara Nest Therapy ("we", "us") collects, uses, stores and protects your personal information. It is written to meet the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023 and its Rules, 2025, as they come into force. Nivaara Nest Therapy is an online counselling practice run by Cherry Narang and Shambhavi Shastri. Under these laws, we are the "data fiduciary" for your information.

Information about your mental health is sensitive personal data under Indian law. We only collect it with your clear consent and treat it with extra care.
2. Why we use it
- To reply to you, match you with a therapist and schedule sessions.
- To provide counselling, therapy and psychological assessments, and keep clinical records.
- To take payments and give receipts or invoices.
- To act in an emergency where there is a serious risk to your life or someone else's.
- To meet our legal obligations.
We do not use your information for advertising, we do not sell or rent it, and we do not use it to train AI tools.
3. Your consent
We ask for your consent before collecting your information, through a checkbox on our site and in our booking form. You can withdraw consent at any time by emailing us. This won't affect anything done before you withdrew. It may mean we can't continue providing therapy, and we may still keep records the law requires us to keep.
4. Who we share it with
- Your therapists. Cherry and Shambhavi can review intake answers and session requests to arrange care. Clinical session notes stay with the therapist you work with.
- Clinical supervision. Therapists sometimes discuss cases with a senior supervisor to keep care safe and high-quality. This is done without your name or identifying details.
- Services we use to run the practice. These include Google (Sheets, Gmail, Calendar, Meet), where booking requests are stored in the clinic's own account; Cloudflare, which runs this website; and WhatsApp. They process data under their own privacy policies and security standards, and may store it on servers outside India.
- When the law requires it. Under the Mental Healthcare Act, 2017 and other laws, we may have to share information without your consent: to protect you or someone else from serious harm, violence or threat to life; on an order from a court or authority such as a Mental Health Review Board; to report the sexual abuse of a child under the POCSO Act, 2012; or where public safety requires it. We share only what is necessary and will tell you when we safely can.
- Anyone else, such as your family, employer, school or college, only with your written consent.
5. How long we keep it
- Enquiries that don't lead to therapy: deleted within one year.
- Clinical records (notes, assessments, consent forms): kept for 3 years after your last session, then securely deleted. For clients under 18, kept until at least 3 years after they turn 18.
- Payment records: kept for as long as tax law requires.
6. How we protect it
We use reasonable security practices. Our accounts are password-protected with two-step verification, notes are stored in encrypted, access-restricted storage, and devices are locked. Intake access is restricted to the clinic; session notes stay with your treating therapist. No system is perfectly secure. If a data breach affects you, we will inform you and the Data Protection Board of India as the law requires.
7. Your rights
You can ask us to:
- tell you what information we hold about you and how we use it;
- correct, complete or update it;
- delete it, unless we're legally required to keep it;
- withdraw your consent;
- name a person who can use these rights for you if you die or become unable to act.
Email nivaaranesttherapy@gmail.com. We aim to reply within 30 days. If you're unhappy with how we handle a concern, write to us again at the same address and we'll look into it within 7 days. If it's still not resolved, you can complain to the Data Protection Board of India.
8. Children and teenagers
We work with teenagers only with the verifiable consent of a parent or legal guardian. We explain to both the teen and the guardian, at the start, what will stay private between the teen and the therapist and what may be shared with the guardian, for example if there is a risk to safety.
9. Changes to this policy
If we change this policy, we'll update the date at the top. If the changes are important, we'll tell current clients directly.

Our services
Nivaara Nest Therapy offers online counselling, psychotherapy and psychological assessments by counselling psychologists. We are not a medical or psychiatric service. We don't prescribe medication or give medical diagnoses. If you need a psychiatrist or other medical care, we'll help you find a referral.
Who can use them
Adults 18 and over. Under 18, only with a parent or guardian's consent.
Booking and payment
- Sessions are 50 minutes, online. Your therapist may extend a session to 75 minutes if needed.
- Fees follow a sliding scale of ₹800, ₹1,000 or ₹1,200 per session or assessment. You choose honestly, and we don't ask for proof. We may change fees with advance notice; changes won't affect sessions already paid for.
- Session requests need therapist approval first. Payment is then made in advance to confirm your slot. Invoices and receipts are available on request.
What we ask of you
- Join from a quiet, private place where you can talk freely.
- Give accurate information, including an emergency contact.
- No recording (audio, video or screenshots) of sessions by either side without both people's written consent.
- Be respectful. We may end or pause therapy if there is abusive or threatening behaviour, if fees go unpaid, or if we believe another professional would help you more. If so, we'll offer referrals.
Messages between sessions
WhatsApp and email are for scheduling and short practical questions. They aren't monitored around the clock, and they aren't for crises or therapy between sessions.
No guaranteed outcome
Therapy helps many people, but we can't promise particular results or a set number of sessions.

Liability

Governing law
These terms are governed by the laws of India. Courts in Pune, Maharashtra have jurisdiction over any dispute.
Cancellations & refunds
- 24 hours' notice or more: cancel or reschedule for free, via WhatsApp. If you've already paid, we'll move your payment to a new slot or refund it in full.
- Less than 24 hours, or a missed session: the full fee for your chosen tier is charged. Your therapist may waive this in emergencies or unavoidable situations.
- If you're late: the session still ends at the scheduled time, unless your therapist decides otherwise.
- If we cancel or can't hold the session (including a technical problem on our side): you get a free reschedule or a full refund, whichever you prefer.
- Refund timing: refunds go back to the original payment method within 5–7 working days.
- Free 15-minute intro call: no charge, so nothing to refund.
Informed consent for online therapy
Before your first session, we'll ask you to read and agree to the following. Your therapist will go through it with you and answer any questions.
- What therapy involves. Therapy is a collaborative process. It often helps, but talking about difficult things can feel uncomfortable at times, and things can feel harder before they feel better.
- Your rights. You can ask questions about your therapy at any time, decline any technique, see your records, switch therapists, or stop therapy whenever you want.
- Confidentiality and its limits. What you share stays confidential, except where the law requires otherwise (see section 4 of the privacy policy): serious risk of harm to you or others, the abuse of a child or an elder, a court or authority's order, and anonymous clinical supervision.
- Online-specific risks. Calls can drop, and no online platform is perfectly secure. We use reputable platforms and ask you to join from a private space. If a call drops, your therapist will try to reconnect, then message you on WhatsApp.
- Safety plan. At the first session, we'll ask where you'll usually be during sessions and for an emergency contact, so we can get you help if there is a serious risk to your safety.
- Recording. Sessions are not recorded by either side without both people's written consent.
- Records. Your therapist keeps brief, secure notes as described in the privacy policy.
- Teenagers. A parent or guardian must also consent. We'll agree together at the start what stays private.
- Scope. We are counselling psychologists, not psychiatrists or doctors. We don't prescribe medication and may suggest a medical referral when that would help.

Our psychological assessments (for depression, OCD and ADHD) use standardised psychological tools. They help understand what you're experiencing and plan support. They are not a medical diagnosis. Where a medical diagnosis or medication may help, we'll refer you to a psychiatrist.
Both therapists follow the ethical principles of their profession, including confidentiality, informed consent, and working within their training.
